Here's our situation.

My fiance is on the mortgage and deed of her home along with her brother. She wants take her name off of the loan and deed, what's our options other than the following?

1. Refiance under her brother's name
2. Plead with the lender to take her off without having to refinance
3. Quick Claim / Quit Claim - I've heard of this before but some people have said these claims are not valid in Texas?

Or do we have any other options besides the ones above?

quitclaims DO transfer title. and ARE valid in texas so long as you have it notarized and recorded. but its easier and better to go through a title company/attorney to make sure everything is written up correctly.

only other way to get off the mortgage without refinancing is for her brother to assume it from her. basically a assumption dot will be recorded and your brother is basically saying he'l take responsibility for the loan. might be better to refinance anyways, specially right now.

its really not that complicated/big of a deal, shouldnt be a problem.

If she does a quit claim she will no longer be on title, but she is still on the loan. As for her brother assuming the loan, I don't see too many loans now a days that are assumable. FHA loans are assumable, but most others are not. Still, for this to happen the brother has to qualify for the loan by himself. The last option is for the brother to refinance the home under just his name, but of course he has to qualify.
